Terms and Conditions - Garden Maintenance

Welcome to our Garden Maintenance services. By engaging our services, you agree to the following terms and conditions. Please read them carefully to ensure a clear understanding of our mutual obligations.

1. Introduction

These Terms and Conditions govern the provision of garden maintenance services by our company. They outline the responsibilities of both the service provider and the client.

2. Scope of Services

Our garden maintenance services include, but are not limited to:

  • Regular lawn mowing and trimming
  • Pruning of shrubs and trees
  • Weeding and soil cultivation
  • Planting and fertilizing
  • Pest and disease management

Additional services can be arranged upon request and may incur extra charges.

3. Client Responsibilities

The client agrees to:

  • Provide access to the property during scheduled service times
  • Ensure that all pets are secured or removed from the work area
  • Inform the service provider of any potential hazards or special instructions
  • Provide timely payments as outlined in this agreement

3.1 Property Access

The client must ensure that the service provider has unobstructed access to all areas of the garden that require maintenance.

4. Payment Terms

Payment for services is due as follows:

  • Monthly Services: Payment is due on the first day of each month
  • One-Time Services: Payment is due upon completion of the service

Accepted payment methods include bank transfer, credit card, and cash. Late payments may incur a fee of 5% per month.

5. Termination

Either party may terminate this agreement with 30 days written notice. In the event of termination:

  • The client agrees to pay for all services rendered up to the termination date
  • The service provider will remove any personal equipment or materials from the property

5.1 Immediate Termination

Immediate termination may occur if either party breaches any of the terms outlined in this agreement.

6. Liability

The service provider is responsible for performing services with reasonable care and skill. However, the provider is not liable for:

  • Damage due to acts of nature, such as storms or extreme weather
  • Pre-existing conditions in the garden or property
  • Indirect or consequential damages arising from service provision

Clients are encouraged to inform the provider of any sensitive areas or specific instructions to mitigate potential damages.

7. Governing Law

This agreement is governed by the laws of the jurisdiction in which the services are provided. Any disputes arising from this agreement will be resolved in the appropriate courts of that jurisdiction.

8. Amendments

Any amendments to these terms and conditions must be made in writing and signed by both parties. Verbal agreements or changes are not recognized.

9. Confidentiality

Both parties agree to keep all information exchanged during the course of the service provision confidential, except where disclosure is required by law.

10. Force Majeure

The service provider is not liable for any failure to perform services due to circumstances beyond their control, including but not limited to natural disasters, war, or government regulations.

11. Intellectual Property

All intellectual property created during the provision of services remains the property of the service provider unless otherwise agreed upon in writing.

12. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13. Entire Agreement

This document constitutes the entire agreement between the client and the service provider, superseding any prior agreements or understandings.

14. Notices

All notices under this agreement must be in writing and delivered to the respective parties' addresses as specified in the service contract.

15. Waiver

The failure of either party to enforce any right or provision of this agreement will not be deemed a waiver of such right or provision.

16. Assignment

The client may not assign or transfer their rights or obligations under this agreement without the express written consent of the service provider.

17. Counterparts

This agreement may be executed in counterparts, each of which is deemed an original, but all of which together constitute one and the same instrument.

18. Interpretation

Headings and titles in this agreement are for reference purposes only and do not affect the interpretation of the terms.

19. Indemnification

The client agrees to indemnify and hold the service provider harmless from any claims, damages, or expenses arising out of or related to the client's use of the services.

20. Compliance with Laws

The service provider agrees to comply with all applicable laws and regulations in the performance of their duties under this agreement.

21. Health and Safety

The service provider will adhere to all health and safety regulations while performing services. The client must ensure that the work area is safe and free from hazards.

22. Equipment and Materials

The service provider is responsible for providing their own equipment and materials necessary to perform the services unless otherwise agreed upon.

23. Sustainability Practices

Our garden maintenance services prioritize environmentally sustainable practices. We use eco-friendly products and methods wherever possible to ensure the health of your garden and the environment.

24. Privacy Policy

Any personal information collected from the client will be handled in accordance with our privacy policy. We are committed to protecting your privacy and data.

25. Feedback and Complaints

Clients are encouraged to provide feedback on our services. Any complaints should be directed to the service provider promptly to allow for resolution.

26. Insurance

The service provider maintains appropriate insurance coverage to protect against potential liabilities during the provision of services.

27. Subcontracting

We reserve the right to subcontract any part of the services provided. Subcontractors are bound by the same terms and conditions as outlined in this agreement.

28. Pricing and Estimates

All pricing and estimates provided to the client are subject to change based on the actual scope of work required. Any adjustments will be communicated promptly.

29. Service Availability

While we strive to provide consistent and reliable services, we cannot guarantee availability at all times due to unforeseen circumstances. We will notify clients in advance of any changes to the service schedule.

30. Dispute Resolution

In the event of a dispute, both parties agree to seek mediation before pursuing legal action. This approach ensures conflicts are resolved amicably and efficiently.

31. Limitation of Remedies

The remedies described in this agreement are the sole remedies available to the client. No additional remedies, whether at law or in equity, are available.

32. Acceptance of Terms

By engaging our garden maintenance services, the client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
